ELECTRO SISTEM SRL and B&K ELECTRO SYSTEM SRL, with headquarters in Baia Mare, 4B, 8 Martie St., Maramureș county, tel. +40 262 213581, fax: +40 262 213583, website: www.electro-sistem.com, email: dpo@electro-sistem.com, informs you about processing of your personal data and about the rights you have according to the EU Regulation 2016/679 of the European Parliament and of the Council from 27 April 2016 (hereinafter referred to as the GDPR) and the national law of the protection and security of personal data in force.

The purposes and the legal basis of the processing of personal data

Taking into account the provisions of the national legislation (Law no. 102/2005, amended and updated, Law no. 190/2018, Law no. 506/2004) and European legislation (Regulation 2016/679/EU, Directive 2016/680/EC, Directive 2002/58/CE) in force, ELECTRO SISTEM SRL, and B&K ELECTRO SYSTEM SRL, through its main activity objective, does not process personal data.

ELECTRO SISTEM SRL and B&K ELECTRO SYSTEM SRL understand the importance of safe management of the personal data provided and the use only for the specified purposes. Both companies collect, use and keep your personal data which is provided in accordance with the provisions of the GDPR for the following activities: provision of commercial services, service supply contracts, order fulfillment, marketing, organizing events, recruiting and hiring personnel, training programs, etc.

The legal basis for personal data processing

Your personal data is collected, used and kept only for the fulfillment of the legal obligations in accordance with the art. 6, paragraph b), c), f) of the GDPR. To the extent that special categories of personal data are required, ELECTRO SISTEM SRL and B&K ELECTRO SYSTEM SRL will request your consent in accordance with the provisions of the art. 9 paragraph (2) lit. (1) of the GDPR. The legislation that mainly governs the activities carried out by ELECTRO SISTEM SRL and B&K ELECTRO SYSTEM SRL is the following: Civil Procedure Code, Companies Law no. 31/1990 completed and updated, Accounting Law no. 82/1991 completed and updated, the Fiscal Code, Law no. 277/2015 with subsequent amendments and completions, Labor Law no. 53/2003 with subsequent amendments and completions, Law of National Archives no. 16/1996 amended and updated, Law no. 677/2001, regulation 2016/679/EU, Directive 2016/680/EC, Directive 2002/58/EC.

Types of personal data that we process 

The policy regarding the protection and security of personal data of ELECTRO SISTEM SRL and B&K ELECTRO SYSTEM is to collect only the personal data necessary for the aforementioned purposes and to request to the subjects to communicate only those personal data strictly necessary for the fulfillment of these purposes. The categories of personal data (classical or digital) collected are the following: For personnel recruitment and employment, for training: name, signature, contact details – personal telephone number, email address, home/residence address,  ID, personal identification number. For legal actions and court representations: name, signature, contact details – personal telephone number, e-mail address, home/residence address, ID, personal identification number. For events organization: name, signature, position, profession, name of the employer, contact details – personal/office telephone number, e-mail address, postal address. For concluding services and goods supply contacts: name, position, name of the employer, contact details – personal /office telephone number, e-mail address, postal address. We reserve the right to request other data necessary for the fulfillment of the duties within ELECTRO SISTEM and B&K ELECTRO SYSTEM, strictly in accordance with the legal provisions.

Your personal data are intended for use by the operator and can be communicated as appropriate, according to the present deliverables, to the following recipients: AJOFM, National House of Public Pensions, Territorial Labor Inspectorate, County Health Insurance House, ANAF, etc. The disclosure of the data to third parties is made according to the legal provisions for the categories of recipients specified above.

The period of storage of personal data

Your personal data are stored for the period needed to make all the steps for supporting the production and commercial activities, during the employment relationship, running events, solving, the actions by the competent courts, after which they will be archived.

Your rights

According to the applicable legal provisions, you benefit from the right of access, the right to rectification, the right to delete data, the right to restrict data processing, the right to data portability, the right to opposition and the automated individual decision-making process. Special data processing or processing based on consent

When processing is based on Article 6 (1) (a), “the subject has consented the processing of his personal data for one or more specific purposes” or Article 9 (2) (a) “The subject has given his explicit consent for the processing of this personal data for one or more specific purposes unless the law of the Union or the national law stipulates that the prohibition provided for in paragraph 1, cannot be lifted by the consent of the subject” from the GDPR, you have the right to withdraw your consent at any time, without affecting the legality of the processing carried out on the basis of the consent before its withdrawal. Thus, you can change or remove your consent at any time, and we will act immediately accordingly unless there is a legal reason or legitimate interest in not doing so.
